1. Who we are
Viewee is provided by Viewee Limited ("Viewee", "we", "us", "our"), a company registered in England and Wales under company number 11270921, with its registered office at 167-169 Great Portland Street, 5th Floor, London, England, W1W 5PF.
2. Using Viewee
You agree to use Viewee only for lawful purposes, and in a way that does not infringe the rights of, or restrict or inhibit the use of, the service by anyone else. We develop Viewee continuously and may change, add or remove features at any time.
3. Your account
To use most of Viewee you need an account. You must: give accurate information and keep it up to date; be authorised to act for the organisation you register, and be at least 18; keep your login details secure and not share them; and tell us promptly at [email protected] if you think someone has accessed your account without permission. You are responsible for activity that happens under your account.
4. Free trial and plans
We may offer a free trial of 14 days, with no card required. At the end of a trial, the account moves to a paid plan or is paused. Paid subscriptions are governed by the plan you choose and any order form or separate commercial agreement between us, which sets out fees, term and renewal. Where those terms and these terms conflict, the commercial agreement takes precedence for paying customers.
5. Acceptable use
When using Viewee you must not: break any applicable law or regulation; upload or transmit viruses, malware or anything technologically harmful; attempt to gain unauthorised access to Viewee, its servers, or any connected system, or disrupt the service (including denial-of-service attacks); upload unlawful, defamatory, harmful or infringing content, or personal data you have no lawful basis to collect or share; or copy, resell, or make the service available to third parties except as your plan allows. We may report attacks or attempts to gain unauthorised access to the relevant authorities.
6. Content and data you provide
You keep ownership of the content and data you put into Viewee ("Customer Data"). You grant us a limited licence to host, process and display it only as needed to provide and support the service. You are responsible for having a lawful basis to collect and share the personal data you put into Viewee. Where Customer Data includes personal data, our Data Processing Agreement applies and forms part of these terms.
7. Our content and intellectual property
Viewee, including its software, design, branding and content, is owned by Viewee Limited or its licensors and is protected by intellectual property law. Nothing in these terms transfers any of those rights to you. You must not copy, modify, resell, or reverse-engineer any part of the platform except to the extent the law allows.
8. Availability
We work to keep Viewee available and reliable, but we do not guarantee that it will be uninterrupted or error-free. We may carry out maintenance, sometimes at short notice. Any service-level commitments are set out in the commercial agreement.
9. Linking to and from Viewee
You are welcome to link to Viewee, but you must not imply endorsement or association without our permission. Viewee may contain links to third-party websites we do not control; we are not responsible for their content, or for any loss arising from your use of them. Read their own terms and privacy policies before using them.
10. Disclaimer
Viewee is provided "as is". We make no warranties that the service or its content will be current, accurate, complete, secure or free from bugs. Viewee is a tool to help you capture and act on feedback - it does not provide professional, clinical, legal or regulatory advice. You should get specialist advice before acting on anything within it.
11. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law. Subject to that, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, business, data, goodwill or anticipated savings. Our total liability to paying customers is capped as set out in the commercial agreement.
12. Suspension and closing your account
You can stop using Viewee and close your account at any time in line with your plan. We may suspend or end your access if you breach these terms or fail to pay. When your account ends, Customer Data is available to export for a set window, then deleted in line with the Privacy Policy and Data Processing Agreement.
13. Changes to the service and these terms
We may update these terms from time to time. If we do, we will change the "last updated" date above and, where changes are material, take reasonable steps to let you know. Continuing to use Viewee after an update means you accept the revised terms.
14. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute relating to them or to your use of Viewee.
15. General
If any part of these terms is found to be invalid or unenforceable, the rest continue to apply. If we do not enforce a right straight away, we can still enforce it later. We are not liable for failing to meet these terms because of events beyond our reasonable control.
